2. Information We Collect

Information you provide. We may collect account and waitlist information such as name, email address, phone number, date of birth, and school or campus affiliation; profile information such as username and profile photo; Gift information such as the recipient you designate, the Partner Venue and item selected, and any personal message attached to a Gift; and communications such as support requests, survey responses, and messages you send us.

Identity verification information. Identity verification is performed by Stripe. When you verify your identity, information such as your legal name, date of birth, and government ID details is collected and processed by Stripe under its own privacy policy. We receive verification status and limited confirmation details, not copies of your identification documents.

Payment information. Payment card details are collected and processed directly by Stripe. We never receive or store your full card number. We receive limited transaction details, such as card brand, last four digits, and transaction status, so we can operate the Service and provide support.

Transaction and redemption data. We collect records of Gifts purchased, sent, received, redeemed, expired, and refunded, including amounts, fees, timestamps, the Partner Venue, and redemption status.

Information collected automatically. When you use the Service, we and our service providers automatically collect device and usage information, such as IP address, device type, operating system, browser type, pages viewed, features used, and general location inferred from your IP address. We collect some of this through cookies and similar technologies, which you can manage through your browser or device settings.

Information about others. If you designate a recipient, you provide us information about that person, such as their name and phone number or username. Only provide information about others when you have their permission to do so. We use recipient information solely to deliver and administer the Gift.

3. How We Use Information

We use the information we collect to provide, operate, and maintain the Service; process Gift purchases and redemptions; verify identity, age, and eligibility; notify recipients of Gifts; facilitate redemption at Partner Venues; process payments and refunds through Stripe; detect and investigate fraud, abuse, and violations of our Terms of Service; respond to questions and support requests; send receipts, redemption confirmations, and account notices; send marketing communications that you can opt out of; analyze usage to improve and develop the Service; comply with legal obligations; and enforce our agreements.

4. How We Share Information

We do not sell your personal information. We share information only as described in this Privacy Policy.

• Stripe: to process payments, refunds, and identity verification.
• Partner Venues: limited information needed to fulfill a redemption, such as the recipient's first name, the item purchased, and QR code validity. We do not share your payment details or full profile with venues.
• Service providers: vendors that help us operate the Service, such as cloud hosting, analytics, and communications providers, under agreements that limit their use of your information.
• Legal and safety: when required by law, subpoena, or legal process, or when we believe disclosure is necessary to protect the rights, safety, or property of Cheers, our users, or others.
• Business transfers: in connection with a merger, acquisition, financing, or sale of assets, in which case we will notify you of any change in ownership or use of your information.
• With your consent: for any other purpose you direct or approve.

5. Text Messages and Communications

By providing your phone number, you consent to receive text messages from us related to the Service, such as Gift notifications and redemption codes. Message and data rates may apply. You can opt out of non-essential text messages at any time by replying STOP. You can opt out of marketing emails by using the unsubscribe link in any marketing message. We will still send transactional messages necessary to operate the Service.

6. Data Retention

We retain your information for as long as your account is active and as needed to provide the Service. We retain transaction records for as long as required by tax, accounting, and financial regulations. When information is no longer needed, we delete or de-identify it. If you close your account, we will delete or de-identify your personal information within a reasonable period, except where retention is required by law or needed to resolve disputes or prevent fraud.

7. Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and reliance on Stripe's PCI-compliant infrastructure for payment data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we learn of a security breach affecting your information, we will notify you as required by applicable law.

8. Your Rights and Choices

Depending on where you live, you may have the right to access the personal information we hold about you, correct inaccurate personal information, delete your personal information, receive a copy of your personal information in a portable format, or opt out of marketing communications.

9. Age Restriction

The Service is intended only for individuals 21 years of age or older. We do not knowingly collect personal information from anyone under 21. If we learn that we have collected personal information from someone under 21, we will delete it promptly.
